Participant Waiver & Release of Liability
BY AGREEING TO THIS DOCUMENT, YOU WAIVE CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE. PLEASE READ CAREFULLY.
1. Voluntary Participation & Assumption of Risk I acknowledge that my participation in Nexus Volleyball and my use of the facilities of the Municipality of Strathroy-Caradoc is entirely voluntary. I freely assume all risks associated with this participation, including but not limited to the possibility of personal injury, property damage, or exposure to COVID-19 and other communicable diseases or viruses, even if arising out of the negligence of the Municipality of Strathroy-Caradoc.
2. Release and Indemnity I agree to save harmless and keep indemnified Nexus Volleyball, the Municipality of Strathroy-Caradoc, and the Community Service Department, along with their servants and agents, against any legal liability for losses, damages, claims, actions, or suits arising directly or indirectly from my participation, except as a result of negligence by the Municipality of Strathroy-Caradoc.
3. Safety Compliance I agree to take all up-to-date safety precautions promoted by Canadian health authorities (including Ontario Health and Health Canada) and the Municipality while using these facilities. This includes adherence to handwashing, social distancing, or masking guidelines if required by official health capacity.
4. Insurance Acknowledgment I acknowledge that Nexus Volleyball maintains insurance as required by its municipal facility permits, which includes coverage for personal injury liability and contractual liability. I understand that this release is binding upon my legal representatives and heirs.
5. Binding Legal Agreement I have read this waiver in its entirety before signing and realize that this is a legally binding document. I have had the opportunity to review its terms and am aware that by signing, I am waiving legal rights, including but not limited to the right to sue for damages, howsoever caused. I am not relying on any oral or written statements made by the Municipality regarding the safety of its facilities or the interpretation of this waiver.
Terms & Conditions
1. Minimum Age Requirement
All participants must be 18 years of age or older as of the first day of the season being played. This is a strict requirement of our insurance and municipal permits. Nexus Volleyball reserves the right to request government-issued photo ID at any time. Any team found using an underage player will forfeit all matches in which that player participated, and the player will be removed from the league without a refund.
2. Mandatory Waiver
No athlete is permitted on the sand until a digital waiver is on file.
- Full-Season Players: Must sign the Participant Waiver during the registration process.
- Substitutes: Must sign the Waiver via the website before stepping onto the court. It is the responsibility of the team to ensure any substitutes have read all league policies and signed the Waiver.
- Liability: Teams found playing with un-waived athletes face immediate match forfeiture and potential season suspension.
3. Alcohol, Cannabis, and Illegal Substances
ZERO TOLERANCE. Nexus Volleyball operates on municipal property (Municipality of Strathroy-Caradoc). Provincial law and municipal bylaws strictly prohibit the consumption of alcohol or drugs at these facilities.
- Any player or spectator caught consuming banned substances during league hours will be expelled from the league immediately without warning or refund.
- This policy is non-negotiable to protect our facility permits.
4. Respect for Facilities & Parking
We are guests of the Strathroy community.
- Damage: Any intentional damage to nets, posts, or municipal property will result in a permanent ban and a bill for damages.
- Cleanliness: All trash must be removed. Leave the courts better than you found them.
- Parking: Athletes must park in the designated parking area located behind the West Middlesex Memorial Centre only. Nexus is not responsible for tickets, towing, or damages to vehicles.
5. Spectators & Children
We welcome fans, but safety is paramount in a high-velocity environment.
- Children under the age of 8 must be under the direct supervision of a non-playing adult at all times.
- Spectators must remain outside the designated “Safety Zone” around the courts to avoid injury from errant balls or diving players. The “Safety Zone” includes anything outside of the sanded area.
6. Contact Information & Privacy
Nexus collects athlete data (Email/Phone) solely for league logistics, emergency notifications, and schedule updates. We will never sell your data. By registering, you agree that your name and team name will be displayed on public-facing standings and schedules.
Code Of Conduct Policy
1. The Nexus Standard: Intensity Without Ego
While many leagues are “just-for-fun,” Nexus is First-and-Foremost-for-Competition. We expect:
- Max Effort: Every play, every set.
- Professionalism: We value athletes who take the game seriously but treat opponents with the respect they deserve as fellow competitors.
- Self-Officiating Integrity: Matches are player-reffed. We expect “honesty calls” (touches, net violations). If a dispute cannot be resolved within 30 seconds, the point is re-served. Constant arguing over calls is considered a violation of this code.
2. Prohibited Conduct
The following behaviors are strictly prohibited and will result in disciplinary action:
- Aggressive Physicality: Pushing, shoving, or “ball blasting” (intentionally hitting a ball at an opponent after the whistle).
- Verbal Abuse: Chirping is part of the game; however, personal insults, name-calling, or threatening language (to opponents or partners) is not.
- Toxic Losing: Confrontational behavior following a loss or “checking out” of a match in a way that disrespects the opponent’s time.
3. Inclusion and Anti-Harassment
Nexus Volleyball is committed to a competitive environment free from discrimination. Any language or behavior that targets an individual’s race, religion, gender, or sexual orientation will result in an immediate lifetime ban.
4. Team Captain Responsibility
In our 2v2 format, both players are considered captains and responsible for the team’s conduct. This means both members are specifically tasked with:
- Ensuring all subs have signed waivers.
- Reporting scores accurately and immediately via the website.
- De-escalating heat-of-the-moment conflicts.
5. First Aid & Personal Safety
Athletes are responsible for their own physical readiness.
- First Aid: Nexus suggests every team carries a basic kit (athletic tape, ice packs, antiseptic). Nexus is not responsible for the cost of emergency care.
- Blood Policy: Any player who is bleeding must stop play immediately, leave the court, and cannot return until the wound is securely covered.
- Apparel: Proper athletic attire is required. We recommend removing jewelry (rings, earrings, watches) to prevent injury on the net or sand.
Refund Policy
To ensure league stability and court bookings, the following refund schedule applies for all seasons:
- Withdrawal more than 3 weeks before Season Start: Full refund minus a $25 administrative fee.
- Withdrawal less than 3 weeks before Season Start: 50% refund.
- After Season Start: No refunds will be issued.
Note: If a player is removed from the league for Code of Conduct violations, all fees are forfeited.
Discipline & Complaints Policy
Nexus Volleyball aims to resolve all disputes with transparency and fairness.
- Informal Resolution: Whenever possible, players are encouraged to resolve on-court disputes through direct, professional communication.
- Formal Complaints: If a violation of the Code of Conduct is observed, it must be reported in writing to League Management within 48 hours of the incident.
- Sanctions: League Management reserves the right to issue warnings, match forfeitures, or season-long bans depending on the severity of the violation.
- Refunds: Under no circumstances will players or teams be granted a refund as a result of expulsion.
Media Consent & Release Policy
I hereby grant Nexus Volleyball permission to use my likeness in photographs, videos, or other digital media (“Media”) taken during league play or events.
- I understand that these materials may be used for promotional purposes, including the league website (nexusvb.com), social media, and marketing materials.
- I waive any right to inspect or approve the finished product or any printed or electronic matter that may be used in conjunction with them now or in the future.
- I understand that I will receive no financial compensation for the use of these materials.
Inclement Weather & Cancellation Policy
The safety of our athletes is our primary concern. While Nexus Volleyball aims to provide a full season of high-level competition, play is subject to weather conditions and municipal facility availability.
- Play Conditions: Matches will proceed in rain and wind. Players should prepare for all outdoor elements.
- Lightning Protocol: Play will be suspended immediately if lightning is detected.
- Rescheduling:
- No Guarantee of Rescheduling: Due to strict court permit windows and a condensed summer schedule, Nexus Volleyball does not guarantee that cancelled nights will be rescheduled. We will make every reasonable effort to accommodate makeup dates, but these are subject to court availability.
- Reschedule Format: If a cancellation occurs and a makeup date is possible, the following week will be played as a Double-Header. On these dates, play will commence one hour early at 5:00 PM. To maintain the schedule, these matches will consist of two sets only, with the match winner determined by the highest total point differential.
- No Weather-Related Refunds: Nexus Volleyball is not responsible for, nor will it issue, full or partial refunds or credits for matches or nights cancelled due to inclement weather, lightning, or municipal facility closures.
